These Terms of Service (“Terms”) govern all purchases made from Second Spark LLC (“Second Spark,” “we,” “us,” or “our”) through our website at secondspark.com, in-person at our facility, or through any third-party marketplace where we list goods (collectively, the “Sales Channels”). By completing a purchase through any Sales Channel, you (“Buyer,” “you,” or “your”) agree to be bound by these Terms in their entirety.


1. NATURE OF GOODS — ALL ITEMS ARE PRE-OWNED

1.1 All items sold by Second Spark are used, pre-owned, secondhand, or previously owned goods. This includes items described as “like new,” “excellent condition,” “refurbished,” or similar qualitative descriptions. No item sold by Second Spark should be understood as new, unused, or manufacturer-warranted unless explicitly stated otherwise in the individual product listing.

1.2 Descriptions of item condition (e.g., “good condition,” “minor wear,” “working”) represent our good-faith assessment at the time of listing. Pre-owned goods may contain defects, cosmetic imperfections, signs of prior use, or functional limitations not visible in photographs or described in listings.

1.3 It is the Buyer’s sole responsibility to review all photographs, descriptions, measurements, and condition notes provided in the product listing before completing a purchase. By completing a purchase, you acknowledge that you have reviewed the listing in its entirety and accept the item in its described condition.

1.4 Second Spark makes no warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable law.


2. INSPECTION OF GOODS

2.1 All items are available for in-person inspection prior to purchase at our facility located at:

2.2 Buyer is strongly encouraged to inspect items in person before purchasing, particularly for high-value items, furniture, electronics, and appliances. Failure to inspect an item prior to purchase does not entitle the Buyer to a refund, return, or exchange, except as provided in Section 4.2.

2.3 By completing a purchase without an in-person inspection, the Buyer acknowledges acceptance of the item based solely on the information provided in the product listing.


3. ALL SALES ARE FINAL

3.1 All sales are final and non-refundable. Second Spark does not accept returns, issue refunds, or provide exchanges except as expressly stated in Section 4 of these Terms.

3.2 This policy applies to all purchases regardless of Sales Channel, including but not limited to purchases made through secondspark.com, eBay, Facebook Marketplace, Poshmark, and in-person transactions.

3.3 Buyer’s remorse, change of mind, failure to measure or verify fitment, discovery of pre-existing cosmetic imperfections consistent with used condition, or any other reason not covered by Section 4 does not entitle the Buyer to a refund, return, or exchange.


4. LIMITED EXCEPTIONS

4.1 Carrier-Damaged Items. If an item is damaged during shipping by the carrier, it is the Buyer’s responsibility to file a claim directly with the shipping carrier (USPS, UPS, FedEx, or other carrier used). Second Spark will provide reasonable assistance in the claims process, including documentation of the item’s pre-shipment condition. Second Spark is not liable for damage occurring during transit and will not issue refunds for carrier-damaged goods. Buyer must report shipping damage within seventy-two (72) hours of delivery with photographic evidence.

4.2 Materially Not as Described. If an item is materially different from its listing description — meaning the item is fundamentally not what was advertised (e.g., listed as “working/functional” but non-operational, listed as one item but a different item was delivered, or significant undisclosed damage rendering the item unusable) — Buyer may request a refund within seven (7) calendar days of delivery or pickup. To qualify:

(a) The discrepancy must be material, not cosmetic or minor;
(b) Buyer must provide photographic or video evidence demonstrating the discrepancy;
(c) Buyer must contact Second Spark at hello@secondspark.com within seven (7) calendar days of receipt;
(d) Second Spark reserves the right to require return of the item at Buyer’s expense prior to issuing any refund;
(e) Second Spark’s determination of whether an item is “materially not as described” shall be made in good faith and is final.

4.3 Normal wear, cosmetic imperfections, minor scratches, fading, odors, or other characteristics consistent with used goods do not constitute a material discrepancy under Section 4.2.


5. PAYMENT AND PRICING

5.1 All prices are listed in United States Dollars (USD) and are subject to applicable state and local sales tax.

5.2 Payment must be completed in full at the time of purchase through the payment methods available on the applicable Sales Channel.

5.3 Second Spark reserves the right to cancel any order due to pricing errors, inventory discrepancies, or suspected fraudulent activity.


6. CHARGEBACKS AND FRAUDULENT DISPUTES

6.1 IMPORTANT — PLEASE READ CAREFULLY. By completing a purchase, you agree that filing a chargeback, payment dispute, or payment reversal with your bank, credit card issuer, or payment processor for any reason other than unauthorized use of your payment method constitutes a breach of these Terms.

6.2 If you have a concern about a purchase, you must contact Second Spark directly at hello@secondspark.com before initiating any chargeback or dispute with your financial institution. We are committed to resolving legitimate concerns promptly under the provisions of Section 4.

6.3 Fraudulent Chargebacks. A chargeback is considered fraudulent when:

(a) The Buyer received the item as described and disputes the charge;
(b) The Buyer received the item, used or retained it, and disputes the charge;
(c) The Buyer fails to contact Second Spark to resolve the issue before filing a dispute;
(d) The Buyer misrepresents the transaction to their financial institution to obtain a reversal.

6.4 Consequences of Fraudulent Chargebacks. In the event of a fraudulent chargeback, Second Spark reserves the right to:

(a) Pursue collection of the full purchase amount plus all fees, costs, and expenses incurred as a result of the chargeback, including but not limited to chargeback fees assessed by payment processors, administrative costs, and collection costs;
(b) Refer the outstanding balance to a third-party collections agency, which may report the debt to credit bureaus and pursue all available legal remedies;
(c) Recover reasonable attorneys’ fees and costs incurred in the collection of the debt;
(d) Ban the Buyer from future purchases across all Second Spark Sales Channels;
(e) Report the fraudulent activity to applicable law enforcement agencies.

6.5 By completing a purchase, you acknowledge that you understand and accept these chargeback consequences and that this Section 6 constitutes a material term of the agreement.


7. LOCAL PICKUP AND SHIPPING

7.1 Items available for local pickup must be collected from our facility at 4601 Airport Way South, Seattle, WA 98108 within seven (7) calendar days of purchase unless other arrangements are made. Items not collected within this period may be relisted and the sale forfeited without refund.

7.2 For shipped items, risk of loss passes to the Buyer upon delivery of the item to the shipping carrier. Second Spark is not responsible for delays, damage, or loss caused by the carrier. See Section 4.1 for carrier damage claims.

7.3 Buyer is responsible for verifying the accuracy of the shipping address provided at checkout. Second Spark is not responsible for items delivered to an incorrect address provided by the Buyer.


8. DISPUTE RESOLUTION — BINDING ARBITRATION

8.1 Any dispute, claim, or controversy arising out of or relating to these Terms, any purchase from Second Spark, or the condition, description, or sale of any item (“Dispute”) shall be resolved exclusively through binding arbitration administered in King County, Washington, in accordance with the rules of the American Arbitration Association (“AAA”) then in effect.

8.2 The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final, binding, and enforceable in any court of competent jurisdiction.

8.3 CLASS ACTION WAIVER. You agree that any Dispute shall be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against Second Spark. The arbitrator may not consolidate the claims of more than one party.

8.4 Each party shall bear its own costs and fees associated with the arbitration, except that the prevailing party in any Dispute shall be entitled to recover its reasonable attorneys’ fees and costs from the non-prevailing party.

8.5 Notwithstanding the foregoing, Second Spark reserves the right to pursue collection of outstanding debts under Section 6 through any court of competent jurisdiction in King County, Washington, without first submitting to arbitration.


9. LIMITATION OF LIABILITY

9.1 To the maximum extent permitted by applicable law, Second Spark’s total liability to the Buyer for any claim arising from a purchase shall not exceed the purchase price of the item giving rise to the claim.

9.2 In no event shall Second Spark be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, lost profits, or damage to property, regardless of the theory of liability.


10. GOVERNING LAW

10.1 These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.

10.2 To the extent any proceeding is not subject to arbitration under Section 8, the exclusive jurisdiction and venue shall be the state and federal courts located in King County, Washington.


11. AGE REQUIREMENT

11.1 You must be at least eighteen (18) years of age to make a purchase from Second Spark. By completing a purchase, you represent and warrant that you are at least 18 years old.


12. MODIFICATIONS

12.1 Second Spark reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of our Sales Channels after any modification constitutes acceptance of the updated Terms.

12.2 The Terms in effect at the time of your purchase govern that transaction.


13. SEVERABILITY

13.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.


14. ENTIRE AGREEMENT

14.1 These Terms, together with any product listing description, constitute the entire agreement between Second Spark and the Buyer with respect to the purchase of goods and supersede all prior agreements, understandings, and communications.
