These Terms of Service (“Terms”) govern all purchases made from Second Spark LLC (“Second Spark,” “we,” “us,” or “our”) through our website at secondspark.com, in-person at our facility, or through any third-party marketplace where we list goods (collectively, the “Sales Channels”). By completing a purchase through any Sales Channel, you (“Buyer,” “you,” or “your”) agree to be bound by these Terms in their entirety.

1. NATURE OF GOODS — ALL ITEMS ARE PRE-OWNED

1.1 All items sold by Second Spark are used, pre-owned, secondhand, or previously owned goods. This includes items described as “like new,” “excellent condition,” “refurbished,” or similar qualitative descriptions. No item sold by Second Spark should be understood as new, unused, or manufacturer-warranted unless explicitly stated otherwise in the individual product listing.

1.2 Descriptions of item condition represent our good-faith assessment at the time of listing. Pre-owned goods may contain defects, cosmetic imperfections, signs of prior use, or functional limitations not visible in photographs or described in listings.

1.3 It is the Buyer’s sole responsibility to review all photographs, descriptions, measurements, and condition notes provided in the product listing before completing a purchase.

1.4 Second Spark makes no warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable law.

2. INSPECTION OF GOODS

2.1 All items are available for in-person inspection prior to purchase at: Second Spark LLC, 4601 Airport Way South, Seattle, WA 98108. Inspections by appointment: hello@secondspark.com or (206) 657-7006.

2.2 Buyer is strongly encouraged to inspect items in person before purchasing. Failure to inspect does not entitle the Buyer to a refund except as provided in Section 4.2.

2.3 Purchasing without inspection constitutes acceptance based on the listing information.

3. ALL SALES ARE FINAL

3.1 All sales are final and non-refundable. No returns, refunds, or exchanges except as stated in Section 4.

3.2 This applies to all Sales Channels including secondspark.com, eBay, Facebook Marketplace, Poshmark, and in-person.

3.3 Buyer’s remorse, change of mind, failure to measure, or discovery of cosmetic imperfections consistent with used condition does not entitle a refund.

4. LIMITED EXCEPTIONS

4.1 Carrier-Damaged Items. Buyer must file a claim directly with the shipping carrier. Second Spark will assist with documentation. Report damage within 72 hours of delivery with photographic evidence.

4.2 Materially Not as Described. If an item is materially different from its listing, Buyer may request a refund within 7 calendar days. Requirements: (a) discrepancy must be material, not cosmetic; (b) photographic/video evidence required; (c) contact hello@secondspark.com within 7 days; (d) return at Buyer’s expense may be required; (e) Second Spark’s determination is final.

4.3 Normal wear, cosmetic imperfections, scratches, fading, or odors consistent with used goods are not material discrepancies.

5. PAYMENT AND PRICING

5.1 Prices in USD, subject to applicable taxes. 5.2 Full payment at time of purchase. 5.3 Second Spark may cancel orders due to pricing errors, inventory issues, or suspected fraud.

6. CHARGEBACKS AND FRAUDULENT DISPUTES

6.1 IMPORTANT. Filing a chargeback for any reason other than unauthorized use of your payment method constitutes a breach of these Terms.

6.2 You must contact Second Spark at hello@secondspark.com before initiating any chargeback.

6.3 A chargeback is fraudulent when: (a) Buyer received the item as described and disputes; (b) Buyer received, used, or retained the item and disputes; (c) Buyer fails to contact us first; (d) Buyer misrepresents the transaction to their bank.

6.4 Consequences: (a) Collection of the full purchase amount plus all fees and costs; (b) Referral to a third-party collections agency which may report to credit bureaus; (c) Recovery of attorneys’ fees; (d) Permanent ban from all Sales Channels; (e) Report to law enforcement.

6.5 This Section 6 is a material term of the agreement.

7. LOCAL PICKUP AND SHIPPING

7.1 Pickup within 7 days at 4601 Airport Way South, Seattle, WA 98108. Uncollected items may be relisted without refund. 7.2 Risk of loss passes to Buyer upon carrier delivery. 7.3 Buyer responsible for correct shipping address.

8. DISPUTE RESOLUTION — BINDING ARBITRATION

8.1 All disputes resolved through binding arbitration in King County, WA per AAA rules. 8.2 Single arbitrator; decision is final and binding. 8.3 CLASS ACTION WAIVER: All disputes on individual basis only. 8.4 Prevailing party recovers attorneys’ fees. 8.5 Collections under Section 6 may proceed in court without arbitration.

9. LIMITATION OF LIABILITY

Liability limited to the purchase price. No indirect, incidental, consequential, or punitive damages.

10. GOVERNING LAW

State of Washington. King County jurisdiction.

11. AGE REQUIREMENT

Must be 18+ years old to purchase.

12. MODIFICATIONS

Second Spark may modify these Terms at any time. Terms at time of purchase govern that transaction.

13. SEVERABILITY

Invalid provisions do not affect remaining Terms.

14. ENTIRE AGREEMENT

These Terms constitute the entire agreement between Second Spark and Buyer.
